Complaints against the Buildings Department Complaints against Mr. WU Chi-wai (胡志偉), Mr. LAM Cheuk Tin, Mr. James TO Kun-sun and Dr. Helena Wong Pik-wan of the Democratic Party of Hong Kong With respect to the content of the letter dated 04 August, 2020 from the Buildings Department of Hong Kong to Mr. WU Chi-wai (胡志偉), Legislative Councillor of the Democratic Party of Hong Kong, with reference no.: EB/5120/61/T02N, a copy of which is attached to this e-mail, my responses are as follows: It is reasonable for us to expect that the letter dated 04 August, 2020 from the Buildings Department of Hong Kong to Mr. WU Chi-wai (胡志偉) of the Democratic Party of Hong Kong mentioned above is for responding to the relevant questions/issues in the letter dated 05 June, 2020 with reference no.: SFS-2020-CNY-160 from Mr. WU Chi-wai (胡志偉), Legislative Councillor of the Democratic Party of Hong Kong, to the Buildings Department of Hong Kong. Clearly, the main focuses of the letter dated 05 June, 2020 from Mr. WU Chi-wai of the Democratic Party of Hong Kong to the Buildings Department mentioned above are the relevant aspects of subsection 16 (1)(d) of CAP 123 Buildings Ordinance of the Laws of Hong Kong, and therefore the Buildings Department of Hong Kong must respond to the questions/issues stated in the letter dated 05 June, 2020 from Mr. WU Chi-wai of the Democratic Party of Hong Kong mentioned above specifically for the relevant aspects of subsection 16 (1)(d) of CAP 123 of the Laws of Hong Kong as per Article 64 of the Basic Law, which is as follows: www.basiclaw.gov.hk/en/basiclawtext/chapter_4.html Article 64 of the Basic Law: The Government of the Hong Kong Special Administrative Region must abide by the law and be accountable to the Legislative Council of the Region: ........ it shall answer questions raised by members of the Council; ......... As all people in Hong Kong must understand the Basic Law and the laws of Hong Kong etc., both the staff of the Buildings Department and the Legislative Council members must understand the Basic Law and the laws of Hong Kong including, but not limited to, subsection 16 (1)(d) of CAP 123 of the Laws of Hong Kong ( www.elegislation.gov.hk/hk/cap123?xpid=ID_1438402641778_001 ) and the relevant sections/subsections of CAP 344 Building Management Ordinance ( www.elegislation.gov.hk/hk/cap344 ) etc.. Clearly, for reasons mentioned in this email and/or mentioned before in my previous e-mails, the Buildings Department has been violating the laws of Hong Kong including, but not limited to, subsection 16 (1)(d) of CAP 123 of the Laws of Hong Kong and Article 64 of the Basic Law etc.. .......... However, I would summarize my complaints against the Buildings Department as follows: 1. For reasons mentioned before and/or in this e-mail, the Buildings Department has been failing to execute its duties as per the relevant sections/subsections of CAP 123 including, but not limited to, subsection 16 (1)(d) of CAP 123 and/or other relevant sections/subsections of the Laws of Hong Kong, partly because the Buildings Department is not willing to check whether the owner of the G/F and M/F of Lee Tai Building had obtained the consent of the Incorporated Owners of Lee Tai Building for converting the common parts of Lee Tai Building for its own use in the way mentioned in the e-mails/documents relating to the complaints stated above as per the literal interpretation of subsection no. 16(1)(d) of Cap. 123 Buildings Ordinance. The Buildings Department must fully understand the relevant sections/subsections of CAP 344 Building Management Ordinance of the Laws of Hong Kong including section 18 and section 34I etc. of CAP 344 of the Laws of Hong Kong. If the staff of the Buildings Department do not fully understand such relevant sections/subsections of CAP 344 of the Laws of Hong Kong, they would not be able to correctly identify and/or communicate with the wrongdoers relating to unauthorized buildings works. www.elegislation.gov.hk/hk/cap344?xpid=ID_1438403038456_002 2. The Buildings Department has failed to properly respond to my e-mails and/or the relevant correspondence from Mr. WU Chi-wai/the Democratic Party of Hong Kong including, but not limited to, ........ As I have expressed in my previous e-mails to you, the responses of the Buildings Department with respect to the captioned complaints are evasive, inadequate and misleading. The Buildings Department has not yet properly mentioned/stated anything with respect to the interpretation and/or execution of subsection no. 16(1)(d) of Cap. 123 Buildings Ordinance and/or other relevant provisions of the laws of Hong Kong. 牛頭不對馬嘴! As such, the Buildings Department has not yet answered the questions in the letter dated 05 June, 2020 from Mr. WU Chi-wai (胡志偉), Legislative Councillor of the Democratic Party of Hong Kong, to the Buildings Department and the letter dated 04 August, 2020 from the Buildings Department of Hong Kong to Mr. WU Chi-wai (胡志偉) is meaningless. Therefore, the Buildings Department has violated Article 64 of the Basic Law. ................ However, I would summarize my complaints against the Legislative Council members of the Democratic Party of Hong Kong including Mr. LAM Cheuk Tin, Mr. James TO Kun-sun, Dr. Helena Wong Pik-wan and Mr. WU Chi-wai (胡志偉) etc. and/or the Democratic Party of Hong Kong as follows: a. For reasons mentioned before in my previous e-mails and/or in this e-mail, Mr. LAM Cheuk Tin, Mr. James TO Kun-sun, Dr. Helena Wong Pik-wan and Mr. WU Chi-wai (胡志偉) fail to execute their powers and duties as per Article 73 of the Basic Law in the ways mentioned in my previous e-mails ............... www.basiclaw.gov.hk/en/basiclawtext/chapter_4.html Article 73 of the Basic Law is as follows: The Legislative Council of the Hong Kong Special Administrative Region shall exercise the following powers and functions: ................................. ( 8 ) To receive and handle complaints from Hong Kong residents; ............................................... ( 10 ) To summon, as required when exercising the above-mentioned powers and functions, persons concerned to testify or give evidence. Particularly, Mr. LAM Cheuk Tin, Mr. James TO Kun-sun, Dr. Helena Wong Pik-wan and Mr. WU Chi-wai (胡志偉) have failed to execute their powers and duties as per sections/subsections 5, 6, 8 and 10 etc. of Article 73 of the Basic Law, partly because they have not yet summoned 富臨集團有限公司 and 正冬火鍋料理 (旺角太子道西103號地下) to testify or give evidence as per Article 73 of the Basic Law with respect to the complaints stated above and or before in my previous e-mails sent to you and ask 富臨集團有限公司 and 正冬火鍋料理 (旺角太子道西103號地下) the following question(s): "Has 富臨集團有限公司/正冬火鍋料理 (旺角太子道西103號地下) obtained the consent of the Incorporated Owners of Lee Tai Building as per Cap 344 Building Management Ordinance for converting the relevant common parts of Lee Tai Building in the way mentioned before for its own use? If so, 富臨集團有限公司/正冬火鍋料理 (旺角太子道西103號地下) is to provide all the relevant evidence(s) as per Article 73 of the Basic Law." Moreover, Mr. LAM Cheuk Tin, Mr. James TO Kun-sun, Dr. Helena Wong Pik-wan and Mr. WU Chi-wai (胡志偉) has been failing to compel/urge the Buildings Department to properly respond to my e-mails and/or......... I hereby urge you to execute your duties mentioned above and/or before properly and immediately .............. before the Legislative Councillors of the Democratic Party of Hong Kong leave the Legislative Council in December of 2020.
